EPF amnesty regularises unapproved provident-fund trusts
One line
The EPF Scheme 2026 gives eligible employer-run provident-fund trusts six months to regularise past operation without a formal exemption order.
Summary
Some establishments run their own provident-fund trusts after income-tax recognition but lack the labour-law exemption required to do so. Retrospective regularisation can protect continuity and bring records under supervision, but it must not erase losses or weaken member benefits.
PYQ pattern
UPSC can test social-security reform through EPFO, employer and employee contributions, exempt establishments, portability, formalisation, and the Code on Social Security. See the official UPSC question-paper archive.
Core notes
- The amnesty applies to provident-fund trusts recognised under the Income Tax Act but lacking an exemption under section 17 of the Employees' Provident Funds Act or section 143 of the Code on Social Security.
- The EPF Scheme 2026 was notified on 29 June. Operational guidelines followed on 11 July.
- The window lasts until 28 December 2026.
- The transitional rules waive specified conditions on minimum employee numbers, corpus size, and a three-year compliance record.
- After retrospective regularisation, an establishment may choose to continue as exempt or move to unexempt compliance.
- An exempt establishment generally manages member accounts through its own trust under statutory conditions and EPFO oversight.
- An unexempt establishment remits contributions and account administration through EPFO.
- Regularisation should verify member balances, investment records, interest credit, audit gaps, and transferability. A formal order alone cannot repair a deficient trust.
Prelims lens
- EPFO works under the Ministry of Labour and Employment.
- The Employees' Provident Funds and Miscellaneous Provisions Act provides for provident fund, pension, and deposit-linked insurance schemes.
- Income-tax recognition of a trust and exemption under provident-fund law are separate approvals.
- An exempt trust remains subject to statutory conditions and supervision.
- This amnesty concerns trust exemption status. It is not the same as a scheme for enrolling previously omitted workers.

- An exempt provident-fund trust is free from all EPFO oversight.
- The amnesty window runs for six months from the 29 June notification.

- A. 1 and 2 only
- B. 1 and 3 only
- C. 2 and 3 only
